Relevancy:

Information requested by the Union regarding the bargaining unit has presumed relevancy.

•  Burden is on Employer to disprove relevancy

Information requested by Union on employees outside the bargaining unit does not have presumed relevancy.

•  Burden is on Union to prove relevancy

Note - Employer financial data is presumed relevant only around profit sharing or incentive plans, or if Employer pleads poverty.
